Terms & Conditions

In these terms and conditions:-

We/Us/Our - Refers to Abacus Blinds, trading as “devonblindsonline”.

You/Your - Means the person offering to purchase goods from us.

Goods - Means the blinds or other products manufactured or supplied by us and as described in the Order Form. In the event of a discrepancy between the description of the Goods on the website and that on the Order Form, the description on the Order Form shall be conclusive

Consumer - Means an individual whose use of the Service is for personal purposes only, and not for use in connection with any trade, business or profession;

Order Form - Means the form completed by you online, showing details of the goods which you have offered to purchase from us.

1. Introduction

1.1 Please read these terms and conditions, which govern your use of this website and our supply to you of any goods which you offer to purchase through our on-line facilities. They do not affect your statutory rights.

1.2 Our site invites you to buy Goods from us. A legally binding contract with you will only arise once payment in full for the goods ordered has been received and you have been notified of our acceptance of your order.

1.3 By making an offer to purchase, you agree to be bound by the whole provisions of the Agreement between you and us. If you do not accept these provisions you should not place an order.

2 General

2.1 It is our intention that all the terms of the contract between us and you are contained in these terms and conditions. We accept responsibility under the Agreement for our commitments to you.

2.2 Nothing on our website is intended or shall be interpreted to mean that we are making a legal offer to you to provide the Goods; we are inviting you to make a legal offer to us to purchase the Goods. It is entirely at our discretion to accept or reject the offer to purchase. The Agreement is concluded only when we have accepted your order.

2.3 Payment can be made using any of the methods listed in Clause 3 below and will be debited when we have accepted your order.

2.4 All prices are quoted in UK pounds Sterling and include VAT where applicable and delivery charges.

2.5 Prices shown on the website are valid for a period of 7 days.

2.6 Our acceptance of your order is subject to their availability. We will inform you if we are unable to deliver the Goods which you have ordered and offer either a suitable replacement, or a full refund.

2.7 Every effort has been made to ensure the descriptions and, price of goods are correct. We will inform you as soon as possible in the event of an error in pricing or description coming to our attention. Where we notify you of such an error, you will have the option of either (i) confirming your offer to purchase subject to the corrected description or price, or (ii) retracting your offer to purchase and receiving a full refund of any prepayments.

2.8 Whilst every attempt will be made by we to ensure that the Goods sold and delivered match in every respect any sample or description shown or given or sent to you, any minor or immaterial variation or change in colour or pattern between the sample or description and the goods delivered shall not entitle you to reject the Goods nor to claim any compensation for such variation or change.

3. Payment options

3.1 We accept the following methods of payment, (i) Credit cards, e.g. MasterCard or Visa, (ii) Debit cards, e.g. Switch.

3.2 Payment may be made by any of the methods above and will be debited when we accept your order, or as soon as reasonably practicable thereafter. We will tell you if your payment details cannot be authorised for any reason and may invite you to pay by another method.

4. Your right to cancel this agreement

Important: This clause contains provisions, which limits your rights to cancel the agreement after your order has been accepted by us. Please read it carefully and do not make an offer to purchase the goods unless you agree to this clause.

All goods available from our website are custom made specifically to your requirements or specification. Under the Distance Selling Regulations, you do not have a right to cancel this Agreement once your order has been accepted by us and has entered our manufacturing process, except where the Goods are defective or we are at serious fault.

5. Our right to cancel this agreement

If for reasons beyond our reasonable control, including but not limited to fire, floods, storm, plant breakdown, lock-outs, riots, industrial action which prevents entry to premises, hostilities, non-availability of materials or supplies, we are unable to supply the goods to you, we may cancel the Agreement at any time before the goods are delivered by giving notice to you. We shall promptly repay to you any sums paid by you or on your behalf under or in relation to the Agreement.

6. Errors made by you & withdrawal of your order

6.1 If you wish to withdraw your offer to purchase goods from us prior to our acceptance of your order, you must notify us of this fact in writing.

6.2 If you wish to correct an error made by you in your order to purchase goods from us, you must notify us of this fact in writing as soon as possible.

6.3 As the Goods which you order are manufactured according to the measurements you provide in your order it is very important that your measurements are accurate. We cannot accept the return of the Goods by reason of the measurements provided being incorrect. You are advised to read the How to Measure page of our web-site. Were you fail to inform us prior to our acceptance of your order of incorrect measurements for the Goods, we reserve the right to charge you the full price of the Goods made to the measurements initially received by us from you.

7. Delivery Details

7.1 All deliveries are subject to stock availability and authorisation of your payment.

7.2 We normally aim to deliver Goods within approx 14 working days after we receive your order. If there are any delays we will notify you of such delay as soon as possible

7.3 We can only deliver to addresses within the United Kingdom mainland and will deliver your goods to the address you have provided on the order form.

7.4 We can only deliver the goods to you during office hours, Monday to Friday. We are unable to specify the time at which the goods will be delivered to you.

7.5 If you do not accept delivery of Goods ordered by you within two weeks of our first attempt to deliver the Goods to you, we reserve the right to charge you for any consequential storage costs reasonably incurred by us.

7.6 A signature will be required on delivery of the goods to you. Receipt of a signature at the delivery address will be proof that the order has been delivered to you. Your goods are despatched to you via a National Courier, upon arrival you are required to inspect the goods for signs of damage, if there is any damage to the goods, you MUST sign the drivers delivery slip "GOODS DAMAGED" and inform us immediately of the damage concerned. Failure to follow these instructions may result in the blind or blinds not being replaced.

8. Returns policy

This returns policy does not affect your legal rights

8.1 If you believe that the Goods may be faulty, mis-described, incorrect, or damaged on delivery, please contact us by e-mail, giving a full account of the alleged defect. If it appears to us from your report that the Goods are defective, we shall arrange for a courier to collect the Goods from you. You must make all the goods supplied available for collection by our Courier on a working day. You must pack the goods in their original protective packaging, if available, but in any event adequately for transit of goods of the nature supplied.

8.2 We reserve the right to inspect the goods and to verify that the Goods are defective and those defects are attributable to the Goods supplied as claimed by you. If it does not appear to us that the Goods returned to us are faulty, incorrect, mis-described or were damaged on delivery to you, we shall return the Goods to you and you shall be charged for the reasonable cost for collection and re-delivery. If you do not accept re-delivery of Goods returned to you hereunder, we reserve the right to charge you for any consequential storage costs reasonably incurred by us.

8.3 If your Goods are defective on delivery, you are entitled to return them to us provided you have first contacted us by e-mail giving us details of the defects. Once we have agreed that the Goods should be returned to us, if it appears to us that Goods returned to us are indeed defective, we shall: -

8.3.1 Either replace (with goods of a similar quality and specification) or repair the Goods free of charge, provided that the Goods have not been modified or subject to misuse or negligence; or

8.3.2 If the Goods are defective on delivery and you so request, arrange for a full refund of the price of the defective Goods by crediting your debit or credit card within 30 days of receipt of the defective Goods. Provided that the Goods have not been modified or subject to mis-use or negligence.

8.3.3 We require that all Goods being returned are securely packed and suitably boxed. We recommend that the original packaging is used where possible. We cannot provide additional packaging or boxes for any returning items.

8.4 For the purposes of this Agreement, Goods are not deemed to be “incorrect” by reason of error in any measurements provided by you.

8.5 No liability under clause 8.3 shall arise unless payment has been paid in full on or before delivery.

8.6 Except where you are a consumer, we will not be liable for any indirect or consequential loss or damage or loss of profits arising out of our supply or failure to supply the Goods to You.

8.7 Except where you are acting as a consumer all other warranties, conditions and terms relating to fitness for purpose, satisfactory quality or conditions of the Goods whether implied by statute or common law or otherwise are excluded to fullest extent of the law.

9. Invalidity

If any part of these terms and conditions is unenforceable (including any provision in which we exclude our liability to you) the enforceability of any other part of these conditions will not be affected.

10. Privacy

We fully respect your right to privacy as laid out in the Data Protection Act 1998

11. Third Party Rights

Except for Our affiliates, directors, employees or representatives, a person who is not a party to this agreement has no right under the UK Contracts (Rights of Third Parties) Act 1999 to enforce any term of this agreement but this does not affect any right or remedy of a third party that exists or is available apart from that Act.

12. Governing Law

This contract is subject to English law and the exclusive jurisdiction of the English courts.

13. Website content

13.1 We have used reasonable care in compiling the content of our website but make no warranty as to the nature or accuracy of any material on the website. Although every effort is made to ensure complete accuracy, some prices or details shown on the website may change from time to time, and it is possible that errors will occur. We will use reasonable endeavours to rectify any errors as soon as possible.

13.2 The product information and photographs contained within our web-site are provided for illustrative purposes only and we cannot warrant that they are accurate. If you are in any doubt as to the precise nature of the product or fabric you wish to order, you are advised to order a free sample of the product.
